Legendary musician Phil Collins will be grilled under oath by his ex-wife’s lawyers over alleged drug use and poor hygiene in a lawsuit over their Miami mansion.

The Genesis singer tried to prevent ex Orianne Bates from suing him for half of their former Miami Beach home, but a judge has ruled the case can go ahead.

Now Bates’ lawyers are planning to put Collins in front of the camera in December when he returns from his comeback tour of Genesis, The Last Domino.

Thanks to an Oct. 8 ruling by Miami judge Carlos Guzman, Bates’ attorney Richard Wolfe can now file a subpoena to question the drummer under oath about the claims.

Collins’ lawyers say his ex’s allegations are “outrageous, abusive, unethical and, for the most part, obviously false or grossly exaggerated.”

Bates, a Swiss-Thai jewelry designer, claimed the 69-year-old Grammy winner “stopped showering, brushing his teeth and dressing properly” from 2019 to August 2020.

Her court records said Collins’ “stench became so ubiquitous that he became a recluse and refused to interact with people personally,” and that she had no choice but to keep her distance from him.

Bates, 46, claimed that Collins started drinking heavily and abusing prescription pills in 2017, claiming that he often “lost weight due to the combination of prescription drugs and excessive alcohol consumption.”

She said he “banged his head on several occasions when he fell, and reported to hospitals under an alias.”

According to her papers, Collins “collapsed on stage while performing because he was so handicapped that he could not get up.”

She also claimed that in 2019, Collins was “increasingly depressed, withdrawn, abusive and after back surgery, became increasingly addicted to antidepressants and painkillers.”

“He was unable to have sex,” she wrote in her lawsuit file. “He stopped showering, brushing his teeth and dressing properly (in fact he didn’t shower or brush his teeth from 2019 until August 2020 when he left.” [their Miami Beach home]).’

Phil’s legal team dismissed Bates’ allegations as “totally unimportant” to the dispute over the house. The lawyer added that Bates’ claims about Collins’ hygiene were “outrageous, abusive, unethical and, for the most part, patently false or grossly exaggerated.”

This comes after Collins spent months trying to get her kicked off his property after she secretly married Bates, an aspiring musician who was 38 years Collins junior, and moved him in.

A source close to the case told DailyMail.com: ‘Phil will now be summoned to make a statement in this case, despite his efforts to stop Orianne and her lawyers.

“It will be uncomfortable for Phil as he is notoriously shy and private, but there will be questions about his life.

Orianne is adamant that she wants the world to know her truth and believes that Phil would give her half of the proceeds from the house, which she says he verbally promised when they broke up.

So questions about Phil’s mindset, mental state, personal behavior and actions are potentially all on the table. Certainly if her attorney could convince a jury that Phil’s mind was being affected by alleged drug and drinking, that would help her case.

“Certainly, while matters about his hygiene and intimate interactions with her may seem frivolous, this potentially paints a picture of the unusual nature of their relationship.

“The ball is now in Phil’s court as to how much he wants to release or discuss publicly, as these statements will be videotaped.”

A friend of Bates’s who declined to be named added: ‘Orianne believes that while her reputation is being questioned, ideally she would just walk away if they split the profits from the house.

“People forget that they still share two children and she feels that even though she loves him, she just wants the good.”

The couple married in 1999 and had sons Nicholas, 19, and Matthew, 15, before splitting seven years later and then shocking the world by getting back together in 2016.

Bates and Collins, who is currently halfway through the Genesis comeback tour The Last Domino, were married for nine years before breaking up in 2008.

They have two sons together, 19-year-old Nicholas and 15-year-old Matthew.

At the time of their split, Collins had to pay Bates a record $46.76 million in their divorce settlement.

The couple reconciled in 2016, but did not remarry and eventually broke up for good. Bates married her new husband, musician and businessman from Miami, Thomas Bates, in August and continued to live in the house she and Collins once shared.

Her attorneys say Phil verbally agreed to give her half the value of the Miami Beach home previously owned by Jennifer Lopez.

A spokesperson for Bates said: “We are pleased with the win in this case, look forward to the progress of the case, and as she has said from the start, we expect justice to be served.”

Wolfe added: “I have spoken to Phil’s counsel and expect his statement sometime in December after his current tour.

“We have always been willing and willing to talk about a solution. Orianne has warm feelings for Phil because they have children together and she only wants what is fair and reasonable, and what Phil agreed to.’
